- The offeror (purchaser) offers to purchase the foreclosure property, pursuant to the terms of a Judicial Sale Listing.
- The purchaser will finance the purchase with a new mortgage. Upon payment of the balance of the funds into Court, title will be transferred into the offeror's name, free and clear of all encumbrances not being assumed by the offeror. The purchaser is not responsible for paying the cost of discharging existing encumbrances.
- If the purchaser fails to complete the purchase, all deposit funds paid by the purchaser will be forfeited to the plaintiff as liquidated damages.
