Ohio Revocable Living Trust Declaration

Set up a living trust for the State of Ohio with this template Ohio Revocable Living Trust Declaration.
  • The trust will operate as the principal means of management and disposition of the estate of the grantor (the person establishing the trust).
  • The grantor will also act as the original Trustee of the trust, and is the primary beneficiary of the trust.
  • The net income and principal of the trust estate will be distributed to the grantor so long as he/she is competent, in accordance with the grantor's instructions.
  • If the grantor is no longer able to manage his/her financial affairs, the trustee (or substitute trustee) will distribute the principal and/or income of the trust to the grantor as the trustee deems necessary to provide for the grantor's support, medical care and maintenance.
  • The trustee is also authorized to make gifts to the grantor's descendants as the trustee considers to be in the best interests of the grantor's estate and family.
  • Upon the death of the grantor, the substitute trustee will pay all claims, expenses and taxes, and then distribute part of the trust estate to the grantor's spouse and put the rest into a family trust, which the trustee will administer in accordance with the terms of the Declaration.
  • The Declaration contains a section governing administration and distribution of separate trusts established for the children of the grantor.
  • After the grantor's death, the trustee's priorities in considering investments and discretionary distributions are set out (spouse's needs, children's needs, etc.).
